1. Who we are

iKlaim is a digital platform specializing in air passenger rights claims. We provide eligibility analysis, claim management, communication with airlines, documentation preparation, and administrative or judicial representation.

We respond within 1 month (GDPR) or 15 business days (LGPD).

3. Data we collect

Identity and contact: name, surname, email, phone, address, ID document (CPF, NIF, passport).

Claim data: airline, flight number, date, airports, information about delays, cancellations or denied boarding; tickets, boarding passes, communications with airlines.

Third-party passenger data: when a claim involves companions, family members or minors.

Documents and authorizations: powers of attorney, representation authorizations, signatures, identity documents.

Banking data: IBAN, account, SWIFT/BIC — when needed for payment transfers.

Navigation data: IP address, user agent, language, pages visited, cookie preferences, consent records.

4. Purposes of processing

Service delivery: eligibility analysis, document preparation, airline communication, claim management.

Contract execution: when you accept our Terms and sign the representation authorization.

Operational communication: document requests, case updates, settlement notifications, payment notifications.

Legal compliance: fiscal, accounting, regulatory or judicial requirements.

Defense of rights: in administrative, judicial or out-of-court proceedings.

Security and fraud prevention.

Analytics and improvement: with consent when required.

Marketing: only with adequate legal basis and specific consent.

6. Data sharing

We share data with: airlines, lawyers, courts, regulatory authorities, Railway (hosting), Zoho (CRM), Google Analytics, technical support providers and payment processors.

iKlaim limits sharing to the minimum necessary and requires data protection commitments from its suppliers.

7. International transfers

For transfers of EU citizens' data outside the EEA, we use GDPR-recognized mechanisms such as Standard Contractual Clauses (SCCs). Our DPA with Railway includes SCCs for EEA→US transfers.

9. Newsletter and marketing

Newsletter subscription is optional. You can unsubscribe at any time via the link in emails, in Account > Privacy, or by emailing privacy@iklaim.com.

Withdrawing marketing consent does not affect operational communications necessary for the service.

10. Data retention

We retain data for as long as necessary to fulfill the described purposes. Active claim data is retained during the process and for the legal defense period. Banking data is kept per fiscal obligations. Marketing data is deleted upon consent withdrawal.

11. Your rights

You have the right to: access, rectification, erasure, portability, restriction, objection, and consent withdrawal.

Response time: 1 month (GDPR).

12. Data export

You can request a copy of your data at Account > Privacy > Download my data. The file is provided in JSON format via a 24-hour temporary link.

13. Account deletion

You can request deletion at Account > Privacy > Delete my account or by emailing privacy@iklaim.com. Some data may be retained when required by legal obligation, contract execution or defense of rights.

14. Security

We implement technical and organizational measures including access control, authentication, encryption in transit (TLS) and at rest, security logs, backups, and incident response procedures.

15. Minors

iKlaim may process minor children's data when necessary for claims submitted by their parents, legal guardians or authorized representatives.

16. Changes to this Policy

This Policy may be updated periodically. The updated version will be published on this page with the update date.
